The Project

“The Regulation provides uniform rules to settle conflicts of jurisdiction between Member States and facilitates the free circulation of judgements, authentic instruments and agreements in the Union by laying down provisions on their recognition and enforcement in another Member State. It complements the Hague Convention of 25 October 1980 on the civil aspects of international child abduction and lays down specific rules with regard to its relation with several provisions provided for in the Hague Convention of 19 October 1996 on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children.”

Report from the Commission to the European Parliament, The Council and the European Economic and Social Committee, on the application of the Council Regulation (EC) No 2201/2003 concerning jurisdiction and the recognition and enforcement of judgements in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000.

 

Cross-border cases related to divorce and parental responsibility and to child abduction are increasing in number and complexity. Related case law and legal instruments have become particularly intricate, where further difficulties and uncertainties arise in the light of their EU nature.The purpose of the project is to develop training materials and organise training events to facilitate uniformity in application of the EU legal instruments on civil judicial cooperation in family matters.

The major topics that are going to be deepened are divorce and parental responsibility dealing with child abduction cases regarding European Private International and Family Law .These two will be part of a series of trainings held by academics and experts in the field of European Private International and Family Law, originating from various Member States. This is the reason why a series of four practice-oriented events are organized to address these issues. Trainings are focused on understanding basic concepts and developing legal and reasoning skills using real cases and hypothetical scenarios.The series of four trainings fall within the activities under the project “EU Judiciary Training on Brussels IIa Regulation: From South to East” coordinated by the University of Milano-Bicocca and led by Prof. Costanza Honorati.

Furthermore the University of Barcelona, the Law Institute of Lithuania, the University of Milano-Bicocca and the University of Rijeka together with their local partners, including judicial schools, jointly organize the project.

The training project is aimed at judges, lawyers, social workers and other experts who are professionally dealing with international abduction cases.
