On Thursday 8th and Friday 9th of June the University of Milano-Bicocca will organize and host a training session which is part of the project “EU Judiciary Training on Brussels IIa Regulation: from South to East”, cofounded by the EU DG Justice and organized by the University of Milano-Bicocca.
The project, lead by Prof. Costanza Honorati, aims to develop training materials and organize training events to promote uniformity in the application of Regulation (EU) No 2201/2003 on civil judicial cooperation in family matters, in particular cross-border cases on International Child Abduction and on Hearing of the Child.
Hearing of the child is a very sensitive issue and it is an essential part of a modern protection of children’s rights. In the past it did not always find a full implementation in judicial practice. This is gradually changing because of the growing awareness of the relevance of the child’s opinion in all the proceedings it is involved in. Nonetheless the concrete exercise of this duty is still an issue: how to approach the child and what questions to ask to ascertain the legally relevant facts, how to recognize manipulation of the child can be essential for the correct outcome of the case. Hearing by qualified people is an exclusive opportunity for children to be informed about the facts that move them and to express wishes about their future. The workshop aims to explore on all relevant concrete issues.
The added value of this training is its emphasis on comparative analysis, not only through analysis of ECJ case law, but also of the most interesting decisions of national courts of EU Member States, and a practical approach.
Training is facilitated through discussion of real cases, which will be distributed among participants and solved together. Using real cases and comparing hypothetical scenarios, the project will develop legal and reasoning skills and promote the emerging of practical guidelines to be consolidated in a final handbook.
